The court refused to alter the nisi costs order because the Commission's evidence was obscure, in particular as to engagement of s179(1)(e), and the defendant's reluctance to comply until formally ordered was not sufficiently unreasonable to justify costs following the event; accordingly the original order of no order as to costs was made absolute and the Commission was ordered to pay costs of the application to vary the costs order.
