The appeal was allowed in part because, given the plaintiff's severe injuries and that the case cannot meaningfully progress to trial or assessment of damages without rehabilitation/occupational therapy evidence, leave should be granted now for a joint occupational therapist and rehabilitation consultant examination and report on the plaintiff's current and future needs (including accommodation).
