The judge applied appropriate starting points, lawfully enhanced them for latent risk given the factual circumstances at each location, properly allowed a one‑third discount for plea and applied the totality principle to arrive at a final total of 20 months; the sentence was not manifestly excessive and leave is refused.

The court allowed the appeal, substituted the trafficking conviction with a conviction for possession under s8 of the Dangerous Drugs Ordinance, accepted the s54A report that the appellant was not drug dependent and unsuitable for admission to a treatment centre, adopted a 24-month starting point (18 months for 20.42 grams ketamine plus 6 months for latent risk), applied credit for the guilty plea and imposed a final term of 16 months imprisonment, setting aside the earlier 4 years 2 months term.

Failure to consider the Commissioner of Correctional Services' report as required by s.54A rendered the original custodial sentence unlawful; the Court of Appeal may quash such a sentence and, after obtaining and considering the report, reimpose an appropriate custodial sentence — in this case two years' imprisonment consecutive with the existing sentence.
