On rehearing the court accepted the magistrate's credibility assessment of PW1 and the dashcam/photos showed V2 was closely following and did not slow; appellant attempted to cut into a lane where there was insufficient space and failed to ensure a safe lane change despite signalling. These facts proved beyond reasonable doubt a contravention of s.38(1) Road Traffic Ordinance (careless driving); therefore the conviction was safe and upheld.
