Leave to appeal was refused because defendants failed to show the court’s exercise of discretion was plainly wrong: the proposed re‑re‑amendments lacked a reasonable prospect of success (PRC law was not relevant to formation of the Cooperation Agreement; the agreement was not shown to be void for uncertainty; many changes were mere embellishments) and defendants did not provide adequate procedural explanations to justify relief from the Unless Order sanction.
