The court held that the defendant's contractual breach occurred when the solicitors omitted to register the sale and purchase agreement in November 1979, so the six-year limitation expired before the writ and the contract claim is time-barred; however, in tort actual loss did not occur until the plaintiff's proprietary interest was extinguished by subsequent events (mortgage in 1987 and sale/assignment in 1988), so the negligence cause of action accrued within the limitation period and may proceed.
