The buyer's letter of 17 October 1975, read as a whole, constituted a withdrawal of the implied assent to appropriation of future monthly deliveries before any appropriation occurred; therefore property did not pass and, because the respondent sued only for the price and not for damages, the appeal is allowed and judgment is entered for the appellant defendant with costs.
