The stay of execution was refused because the appellants failed to show a real prospect of success on appeal sufficient to justify depriving the successful party of the fruits of judgment and failed to demonstrate that the appeal would be rendered nugatory if a stay were refused; the court would not speculate about the admissibility or prospective success of applications for leave to adduce new evidence on appeal and treated the instrument of transfer as having satisfied the operative transfer obligation under the Judgment for the present purpose.
