- Court
- Court of Final Appeal
- Case number
- FACV4/2011
The Court quashed the Tribunal's findings because the admission and circumscribed use of Harbour Ring evidence to 'negative coincidence' and show connection was an error of law made in the absence of adequate evidence and denied the appellants a fair hearing; the remaining evidence was insufficient to sustain the insider dealing findings, so the appeals were allowed and the Tribunal's findings and orders were set aside, subject to a 21-day remitter option for the Financial Secretary.
