The Court allowed the appeal in part, holding that the sentencing judge's 4‑month enhancement was excessive in the particular circumstances; the appropriate enhancement was 1 month on a 30‑month starting point, with the usual one‑third discount for a guilty plea producing an overall sentence of 20 months' imprisonment which replaced the original 22 months.

The Court held the 28-year determinate sentence was within the range of appropriate punishment for a particularly brutal, calculated murder by a youth; the deduction for assistance was generous (possibly unjustified) but not a ground for interference, and the applicant's conduct in custody did not demonstrate exceptional remorse or rehabilitation to justify reducing the term; application dismissed.

Having reconsidered the matter afresh, the court found that the appellant's marked remorse, the probation suitability report and the payment of compensation justified substituting the two month imprisonment (three month starting point less one third) with a 200 hour community service order subject to probationary conditions.
