Detention was lawful and remains reasonable because removal was practicable within a reasonable time, the primary delay was caused by the applicant's persistent refusal to cooperate with reentry formalities, and there were real risks of absconding and reoffending; applying s32(4A), Harjang Singh and Johnson Benjamin the 211‑day detention did not become unlawful.

The detention is lawful and reasonable: the deportation order is valid; the Secretary and Director have acted with reasonable diligence to obtain travel documents and effect removal; the applicant's prolonged detention is attributable to his own unreasonable refusal to cooperate and delayed pursuit of NRC, and there is a real risk of absconding and re-offending, so the detention did not become unlawful and the habeas corpus application is dismissed.

Detention remained lawful because a valid deportation order existed, the Director detained the applicant solely for removal under Immigration Ordinance s32(3), the Director demonstrated reasonable diligence in pursuing travel documents, the bulk of the delay was caused by the applicant's refusal to cooperate, and removal was foreseeable within a reasonable time once the applicant completed re-entry formalities.

Detention was lawful because the Director satisfied the Hardial Singh requirements: intention to remove, reasonable diligence in pursuing repatriation (active liaison with the Consulate and seeking court priority), and a real risk of absconding or reoffending posed by the applicant given his criminal record and refusal to cooperate; moreover delays were attributable in substantial part to the applicant's conduct (passport refusal and late non-refoulement claim), so 309 days was not unreasonable in all the circumstances and the habeas corpus application was dismissed.
