The court held that the parties had reached a binding agreement on essential terms before 18 December 1979 and that the subsequent signed document was only a customary legal formality, not a condition precedent; therefore s.74C applied and the rent increase was unenforceable, judgment for the defendant.

The court held that persons who on 8 June 1973 were in possession of domestic premises subject to a tenancy but who had held over after lawful expiry were tenants at sufferance and thereby fell within the Temporary Provisions Ordinance's protection; accordingly the defendants were not trespassers and the plaintiff's claim was dismissed.

Where a notice to quit given under the Repealed Part II has been challenged by service of a counter-notice, and the notice to quit expired prior to commencement of the New Part II, the Court has no jurisdiction to entertain an application made after commencement of the New Part II under the repealed provisions; the applicant must bring an action by writ under the New Part II and termination of the tenancies will only occur if and when a court order under the New Part II takes effect.
