The Tribunal held it had no Part IV LTCO jurisdiction over the current tenancy disputes but had jurisdiction under the BMO once the tenancy was registered; management charges imposed were unreasonable in part and were reduced to reflect poor service and excluded items improperly passed to tenant; Full Gain remained contractually liable for maintenance despite delegation and breached Clause 3 causing damages; in determining the new rent under s.119K the Tribunal could exceptionally take into account abnormally high management charges and adjusted the market-derived rent downwards accordingly.
