Where defendants have an arguable case that an earlier reduction of rent was agreed and is binding on the Plaintiff (even if the Plaintiff was unaware), interim payments under Ord.29 r.12(b) should be based on the reduced rent claimed by the defendants; the Court allowed the appeal, set aside the master's order and substituted interim payment amounts of $80,000/month from 29 Jan 1999 to 31 Jan 2000 and $100,000/month from 1 Feb 2000, giving credit for any payments already made.
