The court refused to depart from the usual rule that costs follow the event and made the costs order nisi absolute because the proceedings were brought for the private benefit of the plaintiff company; liquidation status and the fact that liquidators are court-appointed do not alter the result; the Oshlack criteria were not satisfied and English protective costs principles did not justify a different order.
