The court found the Plaintiff acted reasonably to mitigate loss by pursuing repossession through correspondence and negotiation, that Gammon’s refusal to release equipment was reasonable under the circumstances, that the alleged offer by Mr Chan lacked credible evidence and therefore no failure to mitigate occurred; accordingly the Plaintiff’s loss computation in Exhibit WCF-48 is accepted and contractual interest is recoverable including after judgment.
