By majority the court upheld the trial judge's exercise of discretion: on the material before him, including inspection and measurements, he reasonably concluded there was no reproduction and no reliable prima facie case of copying; absent a clear misapprehension of evidence the appellate court will not substitute its discretion; therefore the interlocutory injunction was not warranted.
