On the factual findings that the respondent's employment was on a flexible, as‑and‑when basis and that the respondent was entitled to decline particular shift offers within reasonable limits, the employer's conduct and communications unequivocally indicated an end to work for the respondent and therefore amounted to a repudiation of the contract which the respondent validly accepted; there was no persistent disobedience amounting to dismissal for cause and the Presiding Officer's conclusion that the respondent was dismissed by the employer and entitled to statutory payments is upheld.
