By majority the court held that section 114(2) did not apply because by the time the judge made the order (3 June) it was practicable to call meetings (meetings had been convened); the court must assess 'practicability' at the time of the order and the language of s.114(2) and s.113 must not be distorted to import 'immediacy'; accordingly the judge's order under s.114(2) was set aside.
