Where work under the contract is substantially performed in Hong Kong and a temporary absence abroad is incidental to that employment, an accident abroad can be compensable; however, in the present case resting in non‑compulsory guesthouse accommodation was not an incident of employment and the fatality did not arise out of and in the course of employment, so the claim fails.
