The Court held that the creation of beneficial equitable interests (constructive or resulting trusts) in favour of contributors to the purchase price is not an "alienation" within the meaning of s17B of the Housing Ordinance; accordingly such trusts are enforceable and the appeals were allowed to restore first instance declarations.
