There was a serious question to be tried that the defendant breached the Deeds; damages were not an adequate remedy and the balance of convenience favoured granting an interim injunction. The defendant's proposed saving provisions were not supported by the Deeds and were impractical; accordingly an interim injunction was granted in terms of paragraph 1(a) of the summons and no order was made in respect of paragraph 1(b).
