Given that the prior loan did not conclude, the alternatives were supported only by non-binding term sheets, the petitioner (a sophisticated creditor) opposed further adjournment and no compelling reason existed to displace the petitioner’s commercial assessment, the court exercised its discretion to refuse a further adjournment and made the normal winding-up order against Aether Limited.
