The application for leave to appeal was dismissed because the plaintiff failed to demonstrate a good arguable case that the PRC judgments were final and conclusive: the retrial orders in the PRC, on the evidence (including expert opinion), had the effect of suspending or terminating the original judgments so they were not res judicata under Hong Kong conflict of laws; accordingly there was no basis for leave to appeal or for a stay of execution.
