The court held that the plaintiff's judgment plus interest to 26 September 2016 (HK$87,491.53) was inferior to the defendant's second payment-in offer (HK$90,000), therefore under Order 22 r.23 the plaintiff must bear the defendant's costs on an indemnity basis from 27 September 2016; the court ordered the plaintiff's judgment sum plus interest (HK$87,491.53) be paid to the plaintiff from the HK$270,000 lodged and the balance be released to the defendant, ordered payment of costs and interest as specified, and ordered cancellation of the registered writ.
