Because the plaintiff could not give the contractual title/security of tenure, the defendant was not obliged to complete and the plaintiff could not forfeit the payments; accordingly the court ordered possession to the plaintiff against repayment of $78,000 to the defendant, refused interest, damages and mesne profits, and allowed the defendant relief equivalent to a counterclaim for repayment.
