The court held that the Subject Service exceeded the scope authorized by Condition 1 of PSL9396A and therefore constituted an unauthorized service as well as a breach; the Tribunal's pragmatic approach in not distinguishing between s.30(1)(a) and s.30(1)(b) did not amount to reviewable error in the circumstances; and it was lawful for the Commissioner and Tribunal to take into account the applicant's prior breach under a different PSL when determining the sanction.
