The Court held the appellant was an employee for purposes of the Employees Compensation Ordinance: despite some autonomy he was integrated into the respondent's organisation, worked exclusively on the respondent's premises using respondent's materials and machinery, had no real prospect of profit or risk of loss, and therefore control alone did not make him an independent contractor.
