Appeal allowed: considering the undisputed ownership/control links between the 1st defendant and the 2nd–5th defendants together with the Deputy Judge’s findings that there is a serious issue to be tried as to fraud and doubts about the existence of LP units, the Court held there is a good arguable case that the 1st defendant was party to the fraudulent scheme and there is a real risk of dissipation; accordingly the Mareva injunction against the 1st defendant must be continued until trial or further order.
