The defendant caused the collision by reversing without due care but the plaintiff failed to give any credible warning (no horn) while stationary on a yellow box; on foreseeability and causation the plaintiff's failure contributed to the harm and 20% contributory negligence is apportioned to him. The plaintiff failed to prove on the balance of probabilities that the claimed right knee injury was caused by the accident; neck injury was mild soft tissue with limited residual symptoms. Damages were assessed accordingly and reduced by 20% contributory negligence.
