    Citation
SECRETARY FOR JUSTICE v. ANDREW MARC DANK AND ANOTHER
    Court
    Court of Appeal
    Case number
    CAAR7/2007

The community service orders were unduly lenient given the prolonged, planned breach of trust and fraud, the significant sums involved, recruitment of an employee into dishonesty, lack of cooperation and limited objective indicators of remorse; appropriate starting points were custodial (approx. 30 months reduced for plea/delay to 20 months for Dank and 19 months for Lam) but prosecutorial delay and completion of community service warranted substantial reductions, resulting in substituted concurrent sentences of 8 months' imprisonment for Dank and 3 months' imprisonment for Lam.
