The Court held that it was reasonably arguable that CTC has an administrative statutory duty under the Chinese Temples Ordinance to act to safeguard public interest in temple management and that the Applicant has sufficient standing; accordingly the judge erred in refusing leave and leave to apply for judicial review was granted.
