DL's application for leave under the 'otherwise' limb was dismissed because she had been served with a notice of action and failed to join or acknowledge service so the probate judgment bound her under Order 15 r.13A(4); she also exhibited unjustifiable and substantial delay in seeking to set aside the judgment; the rolled-up procedure afforded adequate notice and was not unfair, and there was no arguable ground for leave to the CFA.
