The Court allowed the MSAB's appeal and set aside the costs order against it because an appeal board exercising a quasi‑judicial, adversarial function is ordinarily entitled to adopt the neutral stance recognized in Davies; absent a finding of flagrant improper behaviour the Judge erred in ordering costs against the MSAB. The residents should have been served and joined as interested parties; the Liquor Licensing Board, having adopted a neutral assisting role, was not liable for costs.
