Where an applicant for concurrent registration under s.22 proves honest concurrent use, the court must nevertheless exercise its discretion to refuse registration if the likelihood of confusion and resulting public inconvenience is substantial; untested affidavit evidence of honesty should not be disbelieved absent an irresistible inference of dishonesty, but honest use alone does not mandate registration if the balance of factors (extent of use, degree of confusion, instances of confusion, honesty, and relative inconvenience) disfavors registration.
