The magistrate properly applied Turnbull scrutiny and could accept PW1's identification despite the seven-year gap and an unrelated misidentification; s.20(2) does not require proof that the accused knew the legal character of his conduct, only that he intentionally performed overt acts emulating those of a triad member; the hearsay/co-conspirator points raised did not materially affect the convictions. Consequently the convictions were upheld and the appeal dismissed.
