The court granted the disclosure order against CHB and OCBC under s21 of the Evidence Ordinance and/or Norwich Pharmacal principles because there was cogent and compelling evidence of fraud and a real prospect that the specified disclosure would enable tracing/preservation of assets; but the proprietary injunction and ancillary disclosure order against the 1st Defendant were not continued because the bank records showed the relevant accounts had zero balances and the funds could not be traced to be held by the 1st Defendant.
