On the evidence the advertisements conveyed a substantially true price comparison, would not be misleading to a reasonable Hong Kong audience accustomed to advertising puff, did not take unfair advantage of nor was detrimental to the Plaintiffs' marks, and therefore the Defendant's use was in accordance with honest practices under s21; s18 infringement claims dismissed.
