The court held that s45 is the primary statutory basis for interim measures in aid of foreign arbitration but the legal tests are substantially aligned with s21M principles; on the facts the plaintiff demonstrated a good arguable case, a real risk of dissipation from the defendant's conduct, no material non-disclosure that would vitiate the ex parte order, and the balance of convenience favoured continuation; accordingly the application to discharge the injunction was dismissed and the injunction was continued until further or other order of the arbitral tribunal.
