On re‑hearing the evidence, the court accepted the trial judge's credibility findings and concluded the Crown proved beyond reasonable doubt that the appellant intentionally and indecently touched the complainant on 12 March 2023 (count two) given four separate contacts, sustained contact for seconds on multiple occasions and one instance causing pain; the court nonetheless found reasonable doubt as to the November 2022 incident (count one) and affirmed the acquittal on that count; the appeal was dismissed and the 28‑day immediate custodial sentence on count two was upheld.
