On the totality of unchallenged documentary and circumstantial evidence the court found that on or about 30 June 1983 the reality of the arrangements gave the 2nd applicant a financial interest in Flat A and that the overall scheme was a sham; accordingly the 1st applicant's declaration was false and made with intent to deceive; any error in treatment of a s65B statement did not undermine the safety of the convictions and the proviso under s83(1) CPO was applied to dismiss the appeal.
