Regulation 18(1) is an absolute statutory offence; "the contractor" means the particular contractor engaged in the construction work in respect of which regulation 11 is contravened (including subcontractors by reason of the Cap.59 definition of "contractor"); liability attaches where the contravention is proved to have been committed by the contractor or a person for whom he is responsible (eg his employee).
