The applicant established the trust relationship and proved it had taken reasonable endeavours to contact beneficiaries; accordingly the court had jurisdiction under ss56 and 62 Trustee Ordinance to declare the assets unclaimed and to order their payment into court and disposal in terms of the revised draft order, including sale of low value shares and required publication of the order.
