The Court held the 15 July 1986 telex/agreement was binding and that clause (4) must be read as barring any claim or arrest arising out of the situation created by the defendants' exercise of the alleged lien, which expressly included port and discharging costs; the plaintiffs' arrest breached that undertaking and constituted an abuse of process, so the warrant of arrest was properly set aside and the appeal dismissed.
