The Ombudsman lawfully exercised her statutory discretion to limit the scope of investigation and to refuse continued direct representation by the appellant's solicitors may arguably be challenged but the refusal to investigate the appointment of HKPC and the adequacy of earlier reasons were not reasonably arguable or were rendered academic by the subsequent undertaking of a full investigation; leave to apply for judicial review was granted only on the narrow ground relating to refusal of continued representation.
