Leave to appeal was refused because the questions raised by the applicants were fact-sensitive and not matters of great general or public importance, the trial judge did not go outside the scope of the Preliminary Issues in a way that warrants appellate referral, and the judge properly applied the burden of proof and made positive findings on backdating based on objective evidence and admissible material; case management discretion to direct issues to substantive trial was properly considered and no error was shown.
