Expert evidence was permissible on the specialised question of how escrow letters and proof-of-funds arrangements are used in Hong Kong (Issue 1(a) and 2(a)) because the matter is technical and outside ordinary judicial experience; however the experts will not be permitted to undertake the direct comparison of features (Issues 1(b) and 2(b)) because, once the court is supplied with the expert background on customary practice, it is a straightforward matter of fact for the judge to decide which elements of the particular agreements are consistent or inconsistent with that practice.
