The Court rejected the appellant's proposed requirement of Type C knowledge; the innocent dissemination defence is defeated where the subordinate publisher's lack of knowledge is due to its negligence (i.e. it did not take reasonable care to discover the defamatory content), and on the facts the appellant was negligent in failing to inspect the magazine so the defence fails.
