The Registrar was entitled to find that the Suit Marks are similar to the earlier VITA mark because they share the VITA element which is the more distinctive component; the Relevant Goods are identical or similar; VITA had acquired enhanced distinctiveness through long use and promotion in Hong Kong; and therefore use of the Suit Marks on the Relevant Goods was likely to cause confusion under section 12(3). The appeal was dismissed for those reasons.
