The appellate court found the magistrate erred by failing to give proper weight to evidence of legitimate karaoke customers and the premises' layout and fittings, such that the inference that the premises were used wholly or mainly for organising prostitution was not the only permissible inference; convictions were therefore unsafe and were quashed.

Although the magistrate did not expressly address the separate element that the premises were 'kept' as a vice establishment, the accepted evidence (recruitment of girls and the routine offering of extended sexual services at a stated price) necessarily established that the premises were kept as a vice establishment; the omission did not cause unfairness and the conviction is upheld.

The appellate court held there was no basis to disturb the magistrate's finding that the undercover officers were reliable and that police were not required to caution the Appellant before conducting an undercover operation; accordingly the appeal was dismissed and the conviction upheld.

The magistrate properly inferred from the appellant's active role in greeting and negotiating with undercover officers, offering and providing sexual services through girls, admissions on arrest, and corroborating physical evidence (signboards, separate rooms, condoms) that the premises were being kept as a vice establishment and that the appellant was managing it; a single visit combined with those circumstances sufficed to uphold the conviction.
